Despite the increasingly diversified discourses in international commercial arbitration, this device of socio-legal regulation remains a relatively under-theorized subject. In particular, far too little attention has been paid to analyzing international commercial arbitration through critical approaches such as Third World Approaches to International Law (TWAIL). TWAIL is broadly understood as a methodological reorientation in international law by highlighting the historical links between the foundations of this field of law and the history of capitalism and imperialism as well as the colonial (...) and Eurocentric legacies in the structure and operation of the current international legal regime. With this in mind, two fronts in international commercial arbitration invite a reexamination through a TWAIL perspective and by drawing on the concept of hegemony. One front is the transnational account of arbitration, and the other one is the epistemic community of arbitration. By examining these two notions through a narrative of hegemony of Western legal traditions, we posit that any effective attempt at redefining or reforming arbitral governance structure towards sustaining diversity requires a deeper understanding of historical and current world power structures and creating a vision for the prospect of dehegemonization. Mansour Fahmy, one of the dramatic figures in modern Arab philosophical and social thought. He was the reformist and enlightenment figure in modern Arab history. He is also the owner of a notable current that was subjected to a violent attack that silenced him for a long time and forced him to "hide" physically. However, this did not eliminate the new opinions and positions that came at the beginning of the twentieth century towards the issue of women. He is (...) the first to write with a scientific methodology - from the point of view of sociology - on Islamic discourse and its dealings with women. he sought to differentiate between religion and the religious establishment, between the personality of the Prophet Muhammad and what later prevailed in the books of jurisprudence and others. When he discussed the headscarf issue, he concluded that it was the product of traditions and customs that the Hijab is not from the Islamic religion. Islamic law has nothing to do with the Hijab. Mansour Fahmy's creativity was at one of the sensitive stages in Egypt's modern history in which the political, social, national, cultural, and revolution clashed in each one. All this, in turn, identified the problem of Mansour Fahmy's intellectual personality in the battles of thought and politics. This research's main task is to redraw the features of his actual personality and the reality of his intellectual, social, and political positions. Besides, this study seeks to uncover the effect of philosophy on crystallizing Mansour Fahmy's critical personality and its role in laying the foundations of the critical vision with its practical, reformist, and enlightening dimensions. Omnicide: Mania, Fatality and Future-in-Delirium (2019) finds Iranian-American philosopher and comparative literature theorist Jason Bahbak Mohaghegh carving the figure of the diffracted neo-Bedouin wanderer, whose mania we tail through the book’s haunted pages. The book’s namesake, “omnicide,” refers to the complete and total erasure of the Earth--the term has most recently been generally applied in ecological contexts, most markedly in regards to the Anthropocene and futurology. However, it is the explicitly poetic and literary intersection between mania and the grotesque that (...) Mohaghegh inches us towards, lifting omnicide from its proscriptive use in the Western philosophical/sociological tradition and goading it towards an unfamiliar cryptic terrain. Surveying ten contemporary Middle Eastern poets and fiction writers, including Sadeq Hedayat (Iran), Réda Bensmaia (Algeria), Samuel Adonis (Syria), Joyce Mansour (Egypt), Forugh Farrokhzad (Iran), Ibrahim al-Koni (Libya), Ahmad Shamlu (Iran), Ghada Samman (Lebanon), Mahmoud Darwish (Palestine) and Hassim Blasim (Iraq), Mohaghegh parses curious stanzas and plucks spectral paragraphs from myriad texts so as to navigate the largely occluded and excised narratives of the contemporary Middle Eastern philosophical-literary canon. Not only does Mohaghegh acuminate the multifaceted question of mania and its variegated networks, chambers, byways and sunken burrows--so as to juxtapose two different world literatures (East and West)--but Mohaghegh also illuminates this oeuvre to affront the Western psychoanalytic treatment of mania as an exclusionary vessel. Thus, despite Mohaghegh avoiding any explicit references to Western philosophers and scientists, both the codified dictum of the medical decree and the hyper-genealogical superlative tradition of Georges Canguilhem, Michel Foucault and their contemporaries rankle Omnicide’s annals. Background: Dengue Disease is a mosquito-borne tropical disease caused by the dengue virus, symptoms typically begin three to fourteen days after infection. This may include a high fever, headache, vomiting, muscle and joint pains, and a characteristic skin rash. Dengue serology is applied in different settings, such as for surveillance, in health care facilities in endemic areas and in travel clinics in non-endemic areas. The applicability and quality of serological tests in dengue endemic regions has to be judged against a (...) background of potential cross reactivity with other flavi-viruses, difficulties in distinguishing primary from secondary infections and technological problems related to the fact that most dengue endemic regions are relatively poor of resources .Objectives: to help doctors and patients in diagnosing Dengue Disease and give them the information of how to prevent Dengue Disease and to be able to understand the signs and symptoms of Dengue Disease. Methods: We collected all relevant material for Dengue Disease. Then we designed and implemented a knowledge based system for diagnosing Dengue Disease using SL5 Object Language. Compassion, as an indicator for quality care, is highly valued by patients and healthcare professionals. Compassionate care is considered a moral dimension of nursing practice and an essential component of high quality care. This study aimed to answer these questions: What are the facilitators and barriers of providing compassionate nursing care in the clinical setting? Which strategies do nurses use to provide compassionate care? What is the specific model of compassionate care for the nursing context? A grounded theory approach was (...) used in this study. A total of 21 nurses working in diverse clinical settings participated in the study. Purposive and theoretical sampling was used to select the participants. Data were collected by in-depth face to face interviews and analyzed by the constant comparative method. Ethical approval was gained from the Ethical Review Board of Tabriz University of Medical sciences. The analysis resulted in the development of three main themes: contextual factors affecting compassionate care, the compassionate care actions, and the consequences of compassionate care. The main dimensions of compassionate care are demonstrated in a Compassionate Nursing Care Model. Nurses’ ability on providing compassionate care is influenced by individual and organizational factors that may facilitate or inhibit this type of care. Leadership and nurse managers should remove the barriers which diminish the nurses’ ability to provide compassionate care and support them to engage in compassionate care programs. Identifying and recruiting compassionate nurses, developing their compassionate capacity, and providing role models of compassion could improve the flourishing of person-centered and compassionate care in clinical settings. Physicist Percy Bridgman has been taken by Heather Douglas to be an exemplar defender of an untenable value-free ideal for science. This picture is complicated by a detailed study of Bridgman's philosophical views of the relation between science and society. The normative autonomy of science, a version of the value-free ideal, is defended. This restriction on the provenance of permissible values in science is given a basis in Bridgman's broader philosophical commitments, most importantly, his view that science is primarily an (...) individual commitment to a set of epistemic norms and values. Considerations of external moral or social values are not, on this view, intrinsic to scientific practice, though they have a broader pragmatic significance. What Bridgman takes as the proper relation between science and society is shown through analysis of his many writings on the topic and consideration of his rarely remarked upon involvement in the most problematic example of "Big Science" of his day: the atomic bomb. A reevaluation of Bridgman's views provides a unique characterization of what is at stake in the values in science debate: the normative autonomy of science. (shrink)

The quality of the products coming from different lines of production requires some tests called comparative life tests. For lines having the same facility, the lifetime of the product is distributed by Burr XII, the lifetime distribution, and units are tested under type-I generalized hybrid censoring scheme. The observed censoring data are used under maximum likelihood and the Bayes method to estimate the model parameters. The theoretical results are discussed and assessed through data analysis and Monte Carlo simulation study. Finally, (...) we reported some brief comments obtained from numerical computation. Ubuntu has been defined as a moral quality of human beings, as a philosophy or an ethic, as African humanism, and as a worldview. This paper explores these definitions as conceptual tools for understanding the cultural, educational, and philosophical landscape of post-apartheid South Africa. Key to this understanding is the Althusserian concept of state apparatus. Louis Althusser divides the state apparatus into two forces: the repressive state apparatus (RSA); and the ideological state apparatus (ISA). RSAs curtail the working classes, predominately (...) through direct violence or the threat of violence, whereas ISAs function primarily by ideology, including forms of organised religion, the education system, family units, legal systems, trade unions, political parties, and media. This paper discusses the link between increasing inequality in post-apartheid South Africa and education, with specific reference to Althusser’s ISAs and the abuse of Ubuntu as a subterfuge for socio-economic inequality. This study describes intelligent tutoring system for teaching the Data Manipulation Language (DML) Commands Using SQLite to non IT students to overcome the difficulties they face. The System was built as education system by using the researcher own authoring tool that based on mobile and web App. The basic idea of this system is a systematic introduction into the concept of Database and its DML query. The system presents the topic of DML Commands, help student to execute what they are learn from the system content using the practical part of the system and administers automatically adapted at run time to the student’s individual growth. The system was assessed by a group of teachers and students and the outcome showed as 91% from the database specialists, 94% from Diploma students group and 89% from the secondary school students group. The production of genetically modified crops is growing around the world, and with it possible opportunities to combat food insecurity and hunger, as well as solutions to current problems facing conventional agriculture. In this regard the use of GMOs in food and agricultural applications has increased greatly over the past decade. However, the development of GM crops has been a matter of considerable interest and worldwide public controversy. This, in addition to skepticism, has stifled the use of this practice on (...) a large scale in many areas, including Iran. It stands to reason that a greater understanding of this practice could be formed after a review of the existing expert opinions surrounding GM crops. Therefore, the purpose of this study was to analyze the predictors that influence agricultural experts’ attitudes toward the development of and policies related to GM crops. Using a descriptive correlational research method, questionnaire data was collected from 65 experts from the Agricultural Organization in the Gotvand district in Southwest Iran. Results indicated that agricultural experts were aware of the environmental benefits and possible risks associated with GM crops. The majority of participants agreed that GM crops could improve food security and accelerate rural development, and were proponents of labeling practices for GM crops. Finally, there was a positive correlation between the perception of benefits and attitudes towards GM crops. (shrink)

Sociolinguistics—or the sociology of language—provides such an approach and can help to shed new light on a phenomenon which is often discussed in terms that tend to create more problems than they solve. This paper is based on review of the publications of the Islamic Movement and interviews with its leadership and activists. It argues that the Movement’s resistance to the 1948, 1967 and diasporic dismemberment of Palestine has constituted a critical challenge to Israeli policies, and contributed to reframing the internal Israeli political discourse. That is what led to its being banned by the state. The Islamic Movement was established in the 1970s. It remains, despite its split in 1996 into Northern and (...) Southern branches, a key player in Palestinian minority affairs at the political level, and at the social level through service provision to the marginalized Arab communities, especially in East Jerusalem. In 2015, the Israeli cabinet declared the Northern branch illegal and withdrew its status as a recognized organization. The findings of this paper show that this measure is directly linked to the Movement’s effectiveness in resisting the dispossession of the Palestinians, in advocating their right of return and other human rights, in providing leadership in the struggle over East Jerusalem, and in the organization and delivery of humanitarian services. In this paper, we present a deterministic time discrete mathematical model based on multiregional periodic matrices to describe the dynamics of Sardina pilchardus in the Central Atlantic area of the Moroccan coast. This model deals with two stages (immature and mature) and three spatial zones where sardines are supposed to migrate from one zone to another. The population dynamics is described by an autonomous recurrence equation N(t + 1) = A.N(t), where A is a positive matrix whose entries are estimated (...) using data collected during biannual acoustic surveys carried out from 2001 to 2003 onboard the Norwegian research vessel “Dr Fridtjof Nansen”. The dominant eigenvalue λ of A that gives the long-term growth rate of fish population is smaller than one. This agrees with the stock decrease observed in the data collected. We show that λ is highly sensitive to the recruitment rate and much less sensitive to the reproduction rate. These results can clearly be used to define an efficient scenario in order to fight for instance against a stock decrease. (shrink)

Tomatoes contain a lot of vitamin C and mineral salts, and are recommended for people with constipation, diabetes and patients with heart and body diseases. Studies and scientific studies have proven the importance of eating tomato juice in reducing the activity of platelets in diabetics, which (...) helps in protecting them from developing deadly blood clots. A tomato classification approach is presented with a data set containing approximately 5,266 images with 7 species belonging to tomatoes. Norms provide a valuable mechanism for establishing coherent cooperative behaviour in decentralised systems in which there is no central authority. One of the most influential formulations of norm emergence was proposed by Axelrod :1095–1111, 1986). This paper provides an empirical analysis of aspects of Axelrod’s approach, by exploring some of the key assumptions made in previous evaluations of the model. We explore the dynamics of norm emergence and the occurrence of norm collapse when applying the model over extended durations. It (...) is this phenomenon of norm collapse that can motivate the emergence of a central authority to enforce laws and so preserve the norms, rather than relying on individuals to punish defection. Our findings identify characteristics that significantly influence norm establishment using Axelrod’s formulation, but are likely to be of importance for norm establishment more generally. Moreover, Axelrod’s model suffers from significant limitations in assuming that private strategies of individuals are available to others, and that agents are omniscient in being aware of all norm violations and punishments. Because this is an unreasonable expectation, the approach does not lend itself to modelling real-world systems such as online networks or electronic markets. In response, the paper proposes alternatives to Axelrod’s model, by replacing the evolutionary approach, enabling agents to learn, and by restricting the metapunishment of agents to cases where the original defection is observed, in order to be able to apply the model to real-world domains. This work can also help explain the formation of a “social contract” to legitimate enforcement by a central authority. (shrink)

It is an important issue for economic and finance applications to determine whether individuals exhibit a behavioral bias toward pessimism in their beliefs, in a lottery or more generally in an investment opportunities framework. In this paper, we analyze the answers of a sample of 1,540 individuals to the following question “Imagine that a coin will be flipped 10 times. Each time, if heads, you win \documentclass[12pt]{minimal} \usepackage{amsmath} \usepackage{wasysym} \usepackage{amsfonts} \usepackage{amssymb} \usepackage{amsbsy} \usepackage{mathrsfs} \usepackage{upgreek} \setlength{\oddsidemargin}{-69pt} \begin{document}$$10\texttt{C}\!\!\!\rule[2.3pt]{.4em}{.3pt}\!\!\rule[3.3pt]{.4em}{.3pt}$$\end{docum ent}. How many times do you (...) think that you will win?” The average answer is surprisingly about 3.9 which is below the average 5, and we interpret this as a pessimistic bias. We find that women are more “pessimistic” than men, as are old people relative to young. We also analyze how our notion of pessimism is related to more general notions of pessimism previously introduced in psychology. (shrink)

It is an examination of the curious friendship between writer Aldous Huxley and astronomer Edwin Hubble and its philosophical basis: empiricism. I hope that by consideration of these two thinker''s lives and work light may be shed on each of their ideas and on the 20th century conceptions of empiricism more broadly.

Given the evolution of the public health (PH) and the changes from the phenomenon of globalization, this area has encountered new ethical challenges. In order to find a coherent approach to address ethical issues in PH policy, this study aimed to identify the evolution of public health ethics (PHE) frameworks and the main moral values and norms in PH practice and policy. According to the research questions, a systematic search of the literature, in English, with no time limit was performed (...) using the main keywords in databases Web of Science (ISI) and PubMed. Finally, the full text of 56 papers was analyzed. Most of the frameworks have common underpinning assumptions and beliefs, and the need to balance PH moral obligation to prevent harm and health promotion with respect for individual autonomy has been specified. As such, a clear shift from liberal values in biomedical ethics is seen toward the community’s collective values in PHE. The main moral norms in PH practice and policy included protecting the population against harm and improving PH benefits, utility and evidenced-based effectiveness, distributive justice and fairness, respect for all, privacy and confidentiality, solidarity, social responsibility, community empowerment and participation, transparency, accountability and trust. Systematic review of PHE frameworks indicates utilization of the aforementioned moral norms through an practical framework as an ethical guide for action in the PH policy. The validity of this process requires a systematic approach including procedural conditions. (shrink)

Along the lines of a previous work, the geometrical structure of Hibert bundles describing extended quantum free particles is repeated with Galilei external and internal independent symmetries. Then, in order to introduce the interaction, this structure is extended by replacing configuration and momentum spaces by the socelled spaces of trajectories and extended velocity boosts, respectively. These provide representations giving the probability amplitudes for the particle to follow certain trajectories. The interaction can be introduced in the transformation law from functions on (...) the space of trajectories (free dynamics) to functions on spacetime (intracting dynamics). This transformation law, which makes use of a universal distribution, is seen as a functional in our work according to a quantum functional theory which generalizes the ideas of de Broglie. Intertwining of induced representations gives the free propagator in the space of trajectories and, henceforth, the propagator with interaction in space-time for the extended particle. (shrink)

This paper ascertains genuine principles of Islam while exploring an emerging contradiction between authentic tenets of faith in the Muslims’ heritage of human rights and justice, and a variety of modern targets upheld by OIC Charter and other political and legal instruments to guide a far-sighted authority agenda in pursuit of global equilibrium over key Muslim concerns. The paper ends with operational strategies on sooth conflicting situations of this complex dilemma.

The question of whether females tend to act more ethically or risk-averse compared to males is an interesting ethical puzzle. Using a large sample of US firms over the 1992–2014 period, we investigate the effect that the gender of a chief executive officer has on earnings management using classification shifting. We find that the pre-Sarbanes–Oxley Act period was characterized by high levels of classification shifting by both female and male CEOs, but the magnitude of such practices is, surprisingly, significantly higher (...) in firms with female CEOs than in those with male CEOs. By contrast, our results suggest that following the passage of the punitive SOX Act, classification shifting by female CEOs declined significantly, whilst it remained pervasive in firms with male CEOs. This suggests that the observable differences in financial reporting behavior between male and female CEOs seem to be because female CEOs are more risk-averse, but not necessarily more ethically sensitive than their male counterparts are. The central tenets of our findings remain unchanged after several additional checks, including controlling for alternative earnings management techniques, corporate governance mechanisms, CEO and chief financial officer characteristics and propensity score-matching. In this paper I present and evaluate van Inwagen’s famous Consequence Argument, as presented in An Essay on Free Will. The grounds for the incompatibility of freewill and determinism, as argued by van Inwagen, is dependent on our actions being logical consequences of events outside of our control. Particularly, his arguments depend upon, in one guise or another, the transference of the modal property of not being possibly rendered false through the logical consequence relation, i.e. the β-principle. I argue that, (...) due to the symmetric nature of determinism, van Inwagen is exposed to what I call “reversibility arguments” in the literature. Such arguments reverse the β-principle and start from our apparent control over our own actions to our control over the initial conditions. Since van Inwagen does not endorse a particular theory of laws or logical consequence, he is open to such counterarguments. The plausibility of such reversibility arguments depends on what would be called a Wittgensteinian conception of logical consequence. In the _Remarks on the Foundation of Mathematics_, one of Wittgenstein’s main concerns is the normativity of logical inference i.e. proof. Such concerns with normativity and rule-following are generally a feature of his later philosophy. In the _Remarks_ Wittgenstein resists a conception of logical deduction which places the source of normativity outside of human practice. (shrink)

I provide an account of the physical appropriate to the task of the physicalist while remaining faithful to the usage of “physical” natural to physicists. Physicalism is the thesis that everything in the world is physical, or reducible to the physical. I presuppose that some version of this position is a live epistemic possibility. The physicalist is confronted with Hempel’s dilemma: that physicalism is either false or contentless. The proposed account of the physical avoids both horns and generalizes a recent (...) proposal by Vicente (2011). My account defines physicalism as the thesis that there are no objects that cannot be described by physical quantities. Salgının başlangıç aşamalarında kapsamlı bir çözüm bulunamadığı için âdeta şok yaşayan dünya, salgının yayılmasını önlemek için bir çözüm olarak tamamen karantinaya kapanmak zorunda kaldı. Uzun süren kapanmadan dolayı dünyanın her yerinde insanlar, psikolojik olarak bunalımlı bir dönem geçirmekteler. Hemen hemen herkes, bu bunalımdan bir çıkış yolu aramaktadır. Öte yandan, mezkûr bunalımlı dönemin toplumsal ve dinî açılardan da belirli yankıları olduğu söylenebilir. Örneğin boşanma ve intihar vakalarının artması bunlar arasında gösterilebilir. Dinî açıdan (...) bakıldığında ise, salgının yol açtığı psikolojik yükü hafifletmek için, pek çok bireyin manevi ibadetlere başvurduğu görülmektedir. Böylece, bu psikolojik bunalım hâlinin, temel olarak dinî ilgilendiren birçok soruyu da beraberinde getirdiği dikkat çekmektedir. Kelâm açısından bakıldığında, insan ve Tanrı arasındaki ilişkinin mahiyetine yönelik sorularla karşılaştığımız söylenebilir. Hiç şüphe yok ki Korona, herkes için ağır felaketlere yol açan ve insanların pek haz etmedikleri durumlar arasında kabul edilmekte. Her geçen gün duyduğumuz artan ölüm vakaları; Çin, İran ve Amerika'da karşılaşılan yoğun bakım hastalarının korkunç manzaraları, sıradanlaşır hale geldi. Ancak bireylere sorulduğunda, herkes bu virüsün özü itibariyle oldukça kötü bir durum olduğunu söylemektedir. Konu teolojik açıdan ele alındığında, şu sorular karşımıza çıkmaktadır: eğer Korona bir kötülük olarak görülürse, bu durumun Tanrı’dan gelmesi mümkün müdür? Eğer Tanrı’dan geldiği iddia edilirse, Tanrı’nın bu derece bir eyleme sebep olması nasıl anlaşılmalıdır? Tanrı kötü bir fiille nitelendirilebilir mi? Bu sorular doğal olarak günlük hayatımıza yansıdığı için, pek çok Müslüman belirli açmazlarla karşı karşıya kalmaktadır. Bu çalışmada salgın hastalıklar ve veba konusu, kelâm açısından tartışılarak, üç temel noktaya ışık tutulmaya çalışılacaktır. Birincisi: ağrı ve acı problemi ve bu problemin kelâm kitaplarında nasıl geçtiği ve hangi açılardan tartışıldığı. İkinci olarak ise: “Salgın ve veba meseleleri Allah'ın hükmünden midir, değil midir?” meselesi. Son olarak ise: "Salgınların Allah'ın hükmünden olduğunu söylemek, kulun tedbir almayı bırakmasını mı gerektirir?" sorusudur. In this paper, I take up the question of “how fast does time flow?” This question is usually asked as a rejoinder to the view that time is irreducibly tensed, which is motivated by the fact that we experience the passage of time. I consider what the meaning of this question could be and provide a defence of the view that the passage of time is meaningless (due to its rate of passage being dimensionless), undercutting the motivation for a tensed (...) view of time. Objectivity is one of the most basic and difficult issues in modern and contemporary philosophy. The present paper is devoted to this issue from view- point of Husserl’s transcendental phenomenology. Since perception, particularly sense perception, in view of intentionality, as lowest level of objectivity can act as the base for perceiving the objectivity of other objects, whether real or unreal, it has been discussed in this paper. To do this, objectivity of the sense perception and its role in leading the (...) mind toward essential and ideal objects, and conversely, the role of latter objects in objectivity of the perception itself will be explored. Because the concepts of objectivity and evidence are correlate in Husserl’s philosophy, and since evidence as the self-given manifests itself, from the very beginning, in the lowest level, namely the objects of sense perception, and considering that evidence and objectivity of sense perception concern this lowest level, the critical viewpoint of Husserl’s phenomenology provides a firm and new basis for objectivity if taken at its full competence. As future citizens, students must make decisions requiring an understanding of the interaction of science and technology and its interface with society. STS education has been strongly identified with meeting this goal, but putting theory into practice has so far been difficult. This article asks, “What are the challenges influencing science teachers to implement STS education in the science classroom?” The author investigated using a mixed method research technique incorporating multiple sources of qualitative and quantitative data (questionnaire, interviews, field notes, (...) and classroom observations). Constraints a fecting teachers' practices in teaching science through STS education were identified and can be categorized into impersonal, interpersonal, and personal constraints. Findings indicated interactions within and between external and internal constraints. Suggestions are made for implementing change in various aspects of science teacher education. (shrink)

De la pensée de Bolzano, l’objectivisme sémantique est certainement l’aspect le plus largement commenté. Mais son œuvre maîtresse, la Wissenschaftslehre, comprend aussi bien la version la plus aboutie de cet objectivisme qu’une partie proprement épistémologique, la « Théorie de la Connaissance ». Si l’épistémologie bolzanienne repose sur la désubjectivation des éléments de la connaissance, la théorie de la perception présente dans cette Wissenschaftslehre prête au sujet connaissant un rôle actif dans l’élaboration du réel perceptif.

This article analyses existing biases – whether due to misinterpretation, culture or politics – in the application of women’s rights under Islamic Shari’a law. The paper argues that though in its inception, one purpose of Islamic law may have aimed at elevating the status of women in pre-Islamic Arabia, biases in interpreting such teachings have failed to free women from discrimination and have even added “divinity” to their persistent subjugation. By examining two case studies – Saudi Arabia and Egypt – (...) the article shows that interpretative biases that differ in application from one country to the other further subject women to the selective application of rights. Dictated by norms, culture and tradition rather than a unified Islamic law, the paper shows how culture and politics have contributed to such biases under the pre-text of Islamic dictate. As such, it proposes a re-examination of “personal status” laws across the region in light of international human rights norms. (shrink)

Consistency of choice is a fundamental and recurring theme in decision theory, social choice theory, behavioral economics, and psychological sciences. The purpose of this paper is to study the consistency of choice independent of the particular decision model at hand. Consistency is viewed as an inherently logical concept that is fundamentally void of connotation and is thus disentangled from traditional rationality or consistency conditions imposed on decision models. The proposed formalization of consistency takes two forms: internal consistency, which refers to (...) the property that a choice model does not generate contradictory statements; and semantic consistency, which refers to the idea that a theory’s predictions are valid with respect to some observed data. In addressing semantic consistency, the relationship between theory and data is analyzed in terms of so-called duality mappings, which allow a passage between the two universes in a way that consistency is preserved. The formalization of consistency concepts relies on adapting the revealed preference theory to the context-dependent setting. The paper concludes by discussing the implications of the proposed framework and how it relates to classical revealed preference theory and other formalizations of the relationship between the theory and reality of choice. A sophisticated version of the zombie argument due to David Chalmers runs roughly as follows: a zombie world is ideally primarily conceivable, and whatever is ideally primarily conceivable is primarily possible. Thus, a zombie world is primarily possible, which implies, in turn, that either physicalism is false or Russellian monism is true. Appealing to some plausible mereological considerations, Daniel Giberman presents a novel argument to the effect that zombies are not ideally primarily conceivable. I shall argue, firstly, that a main (...) premise of Giberman's argument is ill-supported, as it trades on a confusion between the primary and the secondary intensions of the "actually" operator. I then consider two lines of reasoning, which might be extracted from Giberman's text, in favour of another chief premise of his argument. I shall argue that the first line of reasoning is flawed, and the second one, in effect, will transform Giberman's argument into a kind of "parity argument" in which his mereological considerations play no role. In this paper a symmetry argument against quantity absolutism is amended. Rather than arguing against the fundamentality of intrinsic quantities on the basis of transformations of basic quantities, a class of symmetries defined by the Π-theorem is used. This theorem is a fundamental result of dimensional analysis and shows that all unit-invariant equations which adequately represent physical systems can be put into the form of a function of dimensionless quantities. Quantity transformations that leave those dimensionless quantities invariant are empirical and (...) dynamical symmetries. The proposed symmetries of the original argument fail to be both dynamical and empirical symmetries and are open to counterexamples. The amendment of the original argument requires consideration of the relationships between quantity dimensions. The discussion raises a pertinent issue: what is the modal status of the constants of nature which figure in the laws? Two positions, constant necessitism and constant contingentism, are introduced and their relationships to absolutism and comparativism undergo preliminary investigation. It is argued that the absolutist can only reject the amended symmetry argument by accepting constant necessitism. I argue that the truth of an epistemically open empirical hypothesis would make the acceptance of constant necessitism costly: together they entail that the facts are nomically necessary. (shrink)
